These are the Terms and Conditions of Hire between Ifco Hire & Sales Pty Ltd Hereinafter called the Owner and the Hirer whose name appears on page (1) in respect to the hire of the building and/or contents as described on page (1) and hereafter referred to as the Building

.

THE OWNER AGREES TO: -

1.

Provide the Building described on page one to the Hirer.

2.

Be responsible for all repairs and replacements required to the Building due to wear and tear.

3.

Transport the Building to and from the location nominated by the Hirer on page one, at the Hirer's expense.

 

THE HIRER AGREES TO: -

1.

Pay the Owner all rental and other charges (if any) as per the terms of payment shown on page one.

2.

Hire the building for the minimum hire period as shown on page one. (Failure to comply will result in penalty rates)

3.

Notify the Owner in writing and obtain an off hire number when arranging the return of the Building.

4.

Use the Building in a manner consistent with its description and not physically alter the Building in any way without the prior consent of the Owner.

5.

Pay a cleaning charge for the Building on return to the Owner.

6.

Accept full responsibility for the safe keeping of the Building and to reimburse the Owner for the cost of rectification of any loss or damage to the Building howsoever caused save wear and tear.

7.

Not to remove the Building from the site address shown on page one without the Owners consent.

 

THE HIRER AGREES THAT: -

8.

There are no warranties made by the Owner expressed or implied beyond or which relate to the description of the Building on page (1).

9.

It is the Hirers responsibility to inspect the building on or before delivery and to ensure that it is in good order and condition and suitable for the Hirer's purpose.

10.

The Hirer indemnifies and will hold indemnified and harmless the Owner and the Owners employees and agents from all damages suits, actions, claims and demands of every description whatsoever and howsoever arising either directly or indirectly from the use of the building

11.

Should the Building be of a type other than the builders shed and of a type or usage which requires or may require the issue by the relevant authority of a Permit prior to its use, the Hirer or at the Hirers request, the Owner shall make application in the name of the Hirer and the Owner shall do all that is necessary to obtain the Permit for the Hirer all at the Hirer's expense.

12.

The Hirer shall indemnify the Owner against any prosecution claim or loss of any kind made against the Owner or suffered by the Owner arising out of the use of the Building without the appropriate permit.

13.

The Hirer shall keep the Building and it's contents insured for the sum shown on page one during the hire period or elect to pay the Theft & Damage waiver monthly fee shown on page one.

14.

Any breach by the Hirer of this Agreement which remains unremedied after seven days following the receipt of a notice specifying the breach and calling on the Hirer to remedy same will result in the immediate termination of this Agreement. Nothing however shall prejudice the rights of either party arising prior to date of termination.

15.

In the event of termination of this Agreement by the Owner that the Owner or agents of the Owner may enter any land or premises of the Hirer or under the Hirer's control and disconnect the services and take possession of the Owners Building.

16.

Should it be necessary for the Owner to take action as in clause 15, and should the Building be connected to distribution equipment owned by an electricity supply authority the Hirer hereby authorizes the Owner to instruct the authority to disconnect the supply.

17.

A late payment fee of 10% per month will be charged on all overdue accounts calculated from date of invoice unless agreed otherwise in writing.

 

17.1.

Should the account fall into arrears and be passed on for debt collection ALL costs including debt collection commission, solicitor's fees and any out of pocket expenses incurred will be the liability of the hirer.

18.

The Owner may assign the whole or any part of it's rights and obligations under this Agreement to any person without the consent of the Hirer.

19.

Where waiver charges have been charged to the Hirer, the Owner agrees upon prompt submission of a written police report (in the case of theft) or a written report by the Hirer in other events to waive its right to claim for loss or damage to the Building and/or contents caused by fire, storm, collision, accident, theft or burglary, provided:

 

19.1.

Adequate precautions have been taken to safeguard the Building and its contents, and

 

19.2.

Such waiving of rights is subject to payment by the Hirer of an excess of:

 

 

19.2.1.

In the event of loss or theft of the Building and/or contents, $200 per item or 20% of the replacement cost (whichever is greater)

 

19.3.

Expressly excluded from the above waiver is loss or damage as defined below:

 

 

19.3.1.

Damage due to misuse, abuse or overloading of the Building and/or contents;

 

 

19.3.2.

Loss or damage in contravention of the conditions of this Hire Agreement;

 

 

19.3.3.

Loss or damage from use in violation of any statutory laws and regulations;

 

 

19.3.4.

Loss or damage to the Building and/or contents whilst located, used, loaded, unloaded, transported on or over water, wharves, bridges or vessels of any kind;

 

 

19.3.5.

Loss or damage to electrical equipment or devices caused by overloading or artificial electrical current, including use of underrated extension leads on electrical powered Buildings and/or accessories;

 

 

19.3.6.

Loss or damage caused by mysterious disappearance or wrongful conversion of the Building and/or contents;

 

 

19.3.7.

Loss or damage during transport, loading and offloading, except where transported by the Owner;

 

 

19.3.8.

Loss or damage to items on which the waiver premium is not charged;

 

 

19.3.9.

Loss or damage caused by theft or burglary at a site location where the building and/or contents are not in a secured or enclosure with adequate security or where prepared by any Insurer of the Building and/or contents states the Hirer contributed or failed to provide adequately secured premises at the site location.

20.

The Owner reserves the right to revise the Schedule of Hire Rates without notice.

These are the Terms and Conditions of Hire between Ifco Access Pty Ltd Hereinafter called the Owner and the Hirer whose name appears on page (1) in respect to the hire of the equipment as described on page (1) and hereafter referred to as the Equipment.

THE OWNER AGREES TO: -
1. Provide the Equipment described on page one to the Hirer.
2. Be responsible for all repairs and replacements required to the Equipment due to wear and tear.

17.2 Such waiving of rights is subject to payment by the Hirer of an excess of:
17.2.1 in the event of loss or theft of the Equipment and/or contents/accessories, $2500 per item or 20% of the replacement cost (whichever is greater)
17.3 Expressly excluded from the above waiver is loss or damage as defined below:
17.3.1 damage due to misuse, abuse or overloading of the Equipment and/or contents/accessories;
17.3.2 loss or damage in contravention of the conditions of this Hire Agreement;
17.3.3 loss or damage from use in violation of any statutory laws and regulations;
17.3.4. loss or damage to the Equipment and/or contents/accessories whilst located, used, loaded, unloaded, transported on or over water, wharves, bridges or vessels of any kind;
17.3.5. loss or damage to electrical equipment or devices caused by overloading or artificial electrical current, including use of underrated extension leads on electrical powered Equipment and/or accessories;
17.3.6. loss or damage caused by mysterious disappearance or wrongful conversion/modification of the Equipment and/or contents/accessories;
17.3.7. loss or damage during transport, loading and offloading, except where transported by the Owner;
17.3.8. loss or damage to items on which the waiver premium is not charged;
17.3.9. loss or damage caused by theft or burglary at a site location where the Equipment and/or contents/accessories are not secured or enclosure with adequate security or where prepared by any Insurer of the Equipment and/or contents/accessories states the Hirer contributed or failed to provide adequately secured premises at the site location.
18. State Government stamp duty tax will be charged as an extra as shown on page one on all hire transactions.
19. The Owner reserves the right to revise the Schedule of Hire Rates without notice.
